Big-box store Carts and equipment

A federal jury in Nashville awarded $3,431,655 to a shopper who was knocked down by a store employee’s cart at a big-box store in Lebanon.

In September 2022 the shopper, then 59 and working as a massage therapist, was bending down to look at mattress protectors when an employee turned a corner pushing an online-order pickup cart loaded with eight or nine crates. The cart struck her and knocked her over. She had surgery to repair a torn labrum in her shoulder and later developed complex regional pain syndrome.

After a three-day trial, the jury found the store 100% at fault and her not at fault. It awarded $731,655 in past and future economic damages and $2.7 million in non-economic damages.

The court reduced the non-economic award to $750,000 under Tennessee’s cap and entered judgment for $1,481,655 on July 18, 2025. A satisfaction of judgment was filed in August 2025.
