A Hinds County jury awarded $876,379 to a tenant who fell on the grounds of her apartment complex in Jackson.
She was leaving her apartment on a dark, rainy night when she walked past a hole filled with rainwater. Stepping around it, she put her foot into a second hole, tripped and fell. She tore the meniscus in her knee and will need a knee replacement in the future.
She sued the complex for failing to maintain the property. The complex argued that holes like these were ordinary in the Jackson area, that she should have seen the danger, and that her knee problems were partly pre-existing.
After a three-day trial ending September 18, 2024, the jury awarded $30,000 in medical bills, $30,378 for future care and $816,001 for pain and suffering. The owner moved for judgment notwithstanding the verdict. We have not found a ruling on that motion or an appeal.
